Personal injury litigation arising from car accidents, slip, trip and fall accidents, or medical malpractice is a notoriously slow process; this begs the question, “How will COVID-19 affect my personal injury claim?”

Unfortunately, in Alberta our already backlogged Court system has been further delayed by closures as a direct result of the COVID-19 pandemic, however, personal injury lawyers across the Province of Alberta have been working together to ensure that the personal injury litigation process continues to move forward.

Some of these accommodations have involved virtual mediations and questionings on web-based platforms such as Zoom, Web-Ex and Microsoft Teams, virtual filing of Court documents, and electronic Applications to the Court.

While it is without question that when the Alberta Courts re-open there will be significantly longer wait times to obtain a Trial Date or to schedule Chambers Applications in order to further prosecute personal injury claims for our clients, we are confident that our judicial system will iron out the kinks expeditiously.

At Law Fifty One, we appreciate the stress and undue hardship that COVID-19 has brought to our personal injury clients and we are taking every step available to us to ensure each and every client’s personal injury claim continues to move towards resolution.

We thank you for your patience and hope that everyone stays safe and healthy!
