Fatal accidents can have an impending impact on the well-being of a family, particularly when a family loses their primary income earner. The loss of a primary income earner can lead to a substantial decrease in financial security and can cause immeasurable damage to those who were formerly dependent on the deceased.
Wrongful death claims are multifaceted and can be difficult to navigate. At Law Fifty-One LLP, our lawyers will prioritize you and your family through the aftermath of a fatal collision by ensuring that you receive proper counsel. Under the Fatal Accidents Act (FAA), you may be entitled to compensation for the wrongful death of a loved one.
Fatal Accidents Act (FAA) of Alberta
In Alberta, the Fatal Accidents Act (FAA) can protect you and your family from expenses incurred as a result of the death of a family member and provide you compensation for the loss of future income. The value of each claim is dependent on a variety of unique circumstances and may be subject to change. A claim can be made by a spouse, adult interdependent partner, parent, child, or sibling and may include the following:
- Expenses incurred for the care and well-being of the deceased person between the time of injury and death;
- Travel and accommodation expenses incurred in visiting the deceased person between the time of the injury and death;
- Expenses of the funeral and the disposal of the body of the deceased, including all things supplied and services rendered in connection with the funeral and disposal;
- Fees for any grief counselling provided to the spouse, adult interdependent partner, parent, child, brother or sister of the person deceased.
The claim will also consider the loss of future income that would have been earned by the deceased had they survived. If the deceased had been supporting a spouse or children, a “Loss of Dependency Claim” may be advanced. In addition, the claim may also include the amount claimable for grief, loss of care, guidance and companionship.
