Missed or Delayed Diagnosis

Missed or delayed diagnoses are common grounds for medical malpractice claims. These claims can occur if a doctor has failed or been late in identifying and diagnosing an injury, condition, or disease. A failure to properly identify or diagnose can result in serious and permanent impairment, illness or even death.

However, a failure to diagnose or a delayed diagnosis does not establish a successful medical malpractice claim.   • The doctor or treatment provider breached the standard of care owed to the patient; and
  • The breach in the standard of care is the cause of the patient’s injuries
